Membership Agreement

How this agreement works

By visiting, accessing, or using any services provided by Replay Sports and Social (“Replay,” “we,” “our,” or “us”), you agree to be bound by the terms of this Membership Agreement. This Agreement governs all memberships, billing, cancellations, renewals, access to facilities, and related services. Continued use of the Services constitutes acceptance of any updates or modifications. If you do not agree with these terms, you must discontinue use immediately. All memberships are selected and processed through Play by Point. All membership options, pricing, and benefits are subject to this Agreement.

Members must be at least 18 years of age, or enrolled by a parent or legal guardian who agrees to be financially responsible.

Replay reserves the right to modify services, policies, hours, features, or operations at its discretion. Temporary closures for maintenance, repairs, renovations, or circumstances beyond our control do not constitute breach of contract.

Contract options

1. 12-month contract

Term

Minimum commitment of twelve (12) months from the membership start date.

Payment

Annual paid in full in advance OR Monthly Direct Debit (minimum 12 payments required).

Early cancellation (annual contract)

Annual contracts are binding for the full 12-month term. If a Member requests early cancellation outside of the Fair Cancellation Policy:

(30) day written notice is required. Verbal cancellations are not accepted.
The Member must pay one additional full month of membership dues, regardless of billing date.
No refunds will be issued.

After completing the initial 12-month term, cancellation requires thirty (30) days written notice prior to renewal.

Upon the completion of the 12-month term, the contract would auto-renew on a month to month basis at the same rate.

Upon the completion of the 12-month term, Replay reserves the right to implement annual increases at its discretion with a (30) day notice to the member. The member reserves the right to accept or decline this increase.

2. Seasonal 6-month contract

Term

Minimum commitment of six (6) months.

Payment

Paid in full OR monthly Direct Debit (minimum 6 payments required).

Early cancellation

If a member requests early cancellation outside of the Fair Cancellation Policy:

(30) Day Written notice is required. Verbal cancellations are not accepted.
The Member must pay one additional full month of membership dues, regardless of billing date.
No refunds will be issued.

After completion of the 6-month term, cancellation requires thirty (30) days written notice prior to renewal.

Upon the completion of the 6-month term, the contract would auto-renew on a month to month basis at the same rate.

Upon the completion of the 6-month term, Replay reserves the right to implement annual increases at its discretion with a (30) day notice to the member. The member reserves the right to accept or decline this increase.

3. Month-to-month contract

Term: Renews automatically each month.
Cancellation policy: Members must provide written notice of cancellation (30) days prior to their next billing date. If notice is not received at least 30 days before the billing date, the upcoming monthly charge will process and is non-refundable. Verbal cancellations are not accepted.

Fair cancellation policy

Applies to 12-month and 6-month contracts only. Cancellation within the commitment period will only be considered under the following circumstances with proper written documentation:

Relocation: Permanent move more than 50 miles (30 miles for 6-month contract).
Long-term illness, injury, or death: Medical documentation required showing inability to exercise for 3+ months.
Hardship: Documented loss of employment or significant financial hardship.
Pregnancy: With written documentation.

3-day right to cancel

Members may cancel penalty-free within three (3) business days of signing, excluding weekends and holidays, in accordance with Florida Health Studio law.

If cancellation is approved under this section, any refund required by Florida law will be calculated accordingly.

Freeze policy

Members may freeze their membership for one calendar month per year with written notice by the 15th of the prior month.

An extended freeze (up to 3 months) may be granted with medical documentation.

Freezing does not reduce the minimum contract term. Contract end dates will extend accordingly.

Clinic & private lesson cancellation policy

Clinic cancellation

Cancellations must be made at least eight (8) hours prior to the scheduled start time. Cancellations made within 8 hours will result in forfeiture of the session fee.

Private lesson cancellation

Cancellations must be made at least forty-eight (48) hours prior to the scheduled lesson to receive a full refund. Cancellations within 48 hours are non-refundable.

Guest pass policy

Members receive three (3 or 6) guest passes per month, subject to availability. Guest passes:

Are equivalent to the Member’s membership privileges.
May not be used by the Member for themselves.
Are non-transferable and may not be sold.

If Replay determines a Member is using guest passes for personal benefit or misuse, Replay reserves the right to suspend or terminate the membership immediately without refund.

Member conduct

Members must abide by all club rules and etiquette policies.

Members 14 and under must be accompanied by an adult and may not access spa or gym areas.

Replay reserves the right to suspend or terminate membership immediately for:

Theft
Criminal activity
Harassment
Misuse of privileges
Non-payment
Violation of club rules

Termination results in forfeiture of all privileges and no refund.

Replay Club communications opt-in

By signing this waiver, you consent to receive marketing and promotional communications from The Replay Club via email and text message, including updates, special offers, events, memberships, and club announcements. Message and data rates may apply. Consent is not a condition of purchase. You may unsubscribe from emails at any time by clicking the unsubscribe link included in our emails, and you may opt out of text messages at any time by replying STOP.

Disclosure

If the club ceases operation, Members must contact the Florida Department of Agriculture within sixty (60) days.

Members must provide identification upon entry when requested.

Acknowledgment

By clicking “Agree” or signing below, you confirm that you have read, understood, and agreed to the terms of this Membership Agreement. Your acceptance is legally binding.

Participant Waiver & Release of Liability

This is a binding legal agreement. As a Participant in the sport of padel and the programs, activities, and events of Replay Club and/or Padel Association, I acknowledge and agree to the following terms:

While participating, I agree to be bound by the Replay Club and/or the Padel Association Code of Conduct, and the tournament conditions of entry, and I agree to conform to all rules and regulations. I understand that my failure to adhere to the Code of Conduct, tournament conditions of entry, or other rules or regulations may result in disciplinary sanctions being imposed upon me.
Replay Club and/or Padel Association, the Hosting Organizing Committee, owners/operators of the facility where the event is being held, sponsors and each of their respective directors, officers, committee members, members, employees, volunteers, officials, participants, agents and representatives (collectively the “Organization”) are not responsible for any injury, personal injury, damage, property damage, expense, loss of income or loss of any kind suffered by me during, or as a result of, the sport of padel and any program, activity or event of the Organization, caused in any manner whatsoever including, but not limited to, the negligence of the Organization.
Participating in Replay Club and/or Padel Association programs or competitions means that the athlete may be filmed or photographed by Replay Club and/or Padel Association or its representatives during the program, competition, or events incidental to the competition. Agreeing to participate in Replay Club and/or Padel Association tournaments means that these videos or images of the athlete may be used and published by Replay Club and/or Padel Association for its own purposes (including but not limited to: pictures on the Replay Club and/or Padel Association website, pictures in Replay Club and/or Padel Association publications, videos in rules clinics and workshops, and videos on the Replay Club and/or Padel Association website and/or social media channels) with the consent of the athlete and/or the consent of athlete’s parent or legal guardian (if the athlete is younger than 18 years old) and without payment to the athlete. Pictures and/or videos created in this manner remain the property of Replay Club and/or Padel Association. The athlete and/or the athlete’s parent or legal guardian (if the athlete is younger than 18 years old) may revoke this consent at any time.

Description of risks

I am participating voluntarily in the sport of padel and the activities, events, and programs of the Organization. In consideration of my participation in the sport of padel and the programs, activities, and events of the Organization, I hereby acknowledge that I am aware of the risks, dangers, and hazards associated with or related to the sport of padel and any such programs, activities, and events of the Organization including injuries which can be severe and even fatal.

The risks, dangers, and hazards include, but are not limited to, injuries from:

Exerting and stretching various muscle groups and strenuous cardiovascular workouts;
Vigorous physical exertion, rapid movements, and quick turns and stops;
Falling to the floor, colliding with the wall(s) or other players;
Being hit by racquets or balls;
Failing to play within one’s abilities and within designated areas;
Failure to properly use any piece of equipment or the mechanical failure of any piece of equipment;
Spinal cord injuries which may render me permanently paralyzed; or
Travel to and from competitive events and associated non-competitive events which are an integral part of the Organization’s activities.

Furthermore, I am aware:

That injuries sustained can be severe;
I may experience anxiety while challenging myself during the activities, events, and programs;
That my risk of injury is reduced if I follow all rules established for participation; and
That my risk of injury increases as I become fatigued.

Release of liability

In consideration of the Organization allowing me to participate, I agree:

My physical condition has been verified by a medical doctor to participate in the sport of padel and the activities, events, and programs of the Organization;
To assume all risks arising out of, associated with or related to my participation;
To waive any and all claims that I may have now or in the future against the Organization;
To freely accept and fully assume all such risks and possibility of personal injury, death, property damage, expense, and related loss, including loss of income, resulting from my participation in the sport of Padel and the activities, events, and programs of the Organization; and
To forever release the Organization from any and all liability for any and all claims, demands, actions, and costs that might arise out of my participation in the activities, events, and programs of the Organization, due to any cause whatsoever, even though such risks, injuries, loss, damage, claims, demands, actions or costs may have been caused by the negligence or breach of any duty of care of the Organization.
